Terms and Conditions of Service:

This is an agreement between you (“Customer”) and My Trash Panda (“My Trash Panda,” “we,” “us,” or “our”). Before using our services, please review these Terms and Conditions of Service and any related policies, notices, pricing details, or additional terms posted on our website (collectively, this “Agreement”). By creating an account, scheduling service, paying for a service, or otherwise using our services, you agree to be bound by this Agreement. If you do not accept these terms, you may not use our services.

By using our services, you enter into a direct contractual relationship with My Trash Panda for the coordination and performance of Roll-In and Roll-Out services.

You understand and agree that My Trash Panda is not a waste hauling company and does not provide trash disposal services. The services provided are limited to moving residential trash and recycling containers to and from the curb for municipal pickup, subject to the terms of this Agreement.

Definitions:

For the purposes of these My Trash Panda Terms and Conditions of Service:

     i.         “My Trash Panda” means My Trash Panda’s Roll-In and Roll-Out service and any related service offerings made available through our website.

    ii.         “Roll In and Roll Out” means the physical service of moving trash and/or recycling containers to the curb for municipal pickup and returning them to the designated storage location after pickup.

   iii.         “Service Provider” means the independent individual performing services on behalf of My Trash Panda. Service Providers may be referred to as “Trash Panda.”

   iv.         “Website” means our web presence where service details, pricing, notices, and updates may be posted, currently located at  https://www.mytrashpanda.online

I.         SERVICE SCOPE

a.     Service:

In accordance with the service option selected at the time of signup or purchase, your assigned Trash Panda will move your trash and/or recycling containers to the curb for municipal collection and return them after pickup to the designated storage location.

b.    Service Timing and Access (Current Requirement):

For current operations, you must ensure your containers are accessible for service no later than 6:00 AM on the day prior to your scheduled municipal collection day.

c.     Future Schedule Adjustments (Expansion Notice):

As My Trash Panda expands and optimizes routes, we may occasionally require containers to be accessible up to two (2) days prior to the scheduled municipal collection day. If this applies to your address or route, you will be notified in advance. When notified, you are responsible for ensuring containers are accessible during the revised service window. If access is not available after notice, service may be missed without credit or adjustment.

d.    Changes to Service

We may modify, suspend, limit, or discontinue any part of our services at any time. We may also revise this Agreement by posting updated terms on our website. Continued use of services after updated terms are posted constitutes acceptance.

e.     Holiday Collection Adjustments

During holiday weeks, municipal trash schedules may change. We will make reasonable efforts to adapt; however, due to inconsistent municipal holiday practices and route changes, we are not responsible for missed pickups during holiday schedule disruptions. If a municipality misses collection, we are not responsible for the missed municipal pickup.

f.      Customer Satisfaction and Reporting Issues

If you believe a service was not completed correctly, you must notify My Trash Panda within 7 days of the service date so we can review and attempt to resolve the issue.

g.     Force Majeure

Neither party will be liable for delays or failures caused by events beyond reasonable control, including severe weather, natural disasters, civil disturbances, government actions, power/telecom outages, labor disruptions, equipment shortages, or other similar events. During such events, service may be delayed, rescheduled, or skipped.

h.    Right to Refuse Service

My Trash Panda reserves the right to refuse service to any property at our discretion, including for safety concerns, access limitations, hazardous conditions, repeated noncompliance, or other operational reasons.

i.      Rental Properties (If Applicable)

If the property is a rental or vacation rental, you (as owner/host/manager) are responsible for notifying guests and occupants that service may occur on scheduled days. If guest presence makes access inappropriate or unsafe, service may be withheld without credit or adjustment.

II. PROPERTY ACCESS AND ON-SITE CONDITIONS

a.     Home Access Authorization

By signing up for service, you authorize My Trash Panda and Your Trash Panda to access the service area(s) you designate solely for the purpose of Roll-In and Roll-Out. You confirm you have authority to grant such access.

b.    Waste Can Access Requirements

You must ensure the Service Provider can access the containers, including providing accurate:

                       i.         Gate codes or lock combinations (if applicable)

                      ii.         Storage location details

                     iii.         Access instructions

                     iv.         Any restrictions (HOA rules, narrow access points, etc.)

If access is not available for any reason, service may not be performed and no credit or adjustment will be issued.

c.     Pet

You are responsible for securing pets. If a pet is loose or the Service Provider determines entry is unsafe, service may be skipped. If you have notifications enabled, we may notify you that service could not be completed.

d.    Vehicles and Obstructions

We will use reasonable care when placing and returning containers. My Trash Panda is not responsible for damage caused by third-party vehicles, road conditions, or any event outside our control.

e.     Garage Access (If You Choose to Provide It)

If you provide garage access, you accept the risks associated with granting access. You are responsible for disabling alarms and ensuring the garage area is safe. My Trash Panda is not responsible for lost items, alarm issues, garage door malfunction, or doors left open due to provided access.

f.      Safety Issues

You are responsible for maintaining safe property conditions including safe walkways, gates, lighting, and hazard-free access routes.

g.     Overloading and Closed Lids

For safety and municipal compliance, containers must not be overloaded and lids must fully close. If containers are unsafe to move or cannot close, service may be refused without credit or adjustment.

h.    Overflowing Trash and Blocked Access

Containers must be reasonably accessible and not blocked by overflow, debris, or obstacles. If access is blocked, service may not be completed.

i.      Inclement Weather and Road Closures

Service may be delayed, rescheduled, or skipped due to severe weather or road closures that prevent safe access. No credits or adjustments will be issued for weather or access conditions beyond our control.

j.      Sanitary Container Condition

If containers are excessively unsanitary (e.g., biohazards, extreme odor, contamination), service may be refused until corrected.

k.    Technology and Communication Limitations

We may use third-party systems (email, SMS, scheduling tools) to coordinate service. We are not responsible for service interruptions caused by third-party outages or telecommunication failures.

III. PRICING AND FEES

a.     Pricing

Pricing is posted on our Website and may vary by service type, access level, and location. By purchasing or scheduling a paid service, you agree to pay the posted price plus applicable taxes (if any).

b.    Current Service Options (As Posted)

My Trash Panda may offer options such as:

                       i.         One-time service

                      ii.         Monthly service

                     iii.         Quarterly service

                     iv.         Add-on fees for gated/backyard access

                       v.         Holiday week surcharges

c.     Free Trials and Promotions

We may offer free trials or promotional pricing. Promotional offers may be limited by time, route availability, and service area. Terms of any promotion will be described at signup or on the Website.

d.    Changes in Price

We may change prices at any time. Price changes will apply prospectively and will be posted on our Website. For subscription customers, we will provide reasonable notice before applying updated pricing to a renewal.

IV. CANCELLATION

a.     Free Trial Customers

You may cancel at any time during a free trial by contacting us at fourbmanagement@gmail.com. If a service has already been completed, no refund is owed for completed work.

b.    Monthly Subscriptions (If Applicable)

If you are on a monthly subscription, cancellation notice must be received at least 15 days prior to the next billing date to avoid the next charge.

c.     Quarterly Subscriptions (If Applicable)

If you are on a quarterly subscription, cancellation notice must be received at least 30 days prior to the next billing date to avoid renewal charges.

d.    No Partial Period Refunds

Unless required by law or explicitly stated in writing, we do not provide partial refunds for unused portions of a subscription period.

V. BILLING AND PAYMENT

a.     Billing Timing

Billing terms depend on the service selected. One-time services may be billed prior to service. Subscriptions are billed in advance at the interval chosen (monthly or quarterly, as applicable).

b.    Payment Issues

If a payment fails or is declined, service may be paused until payment is resolved. We may make additional attempts to process payment as permitted by your payment method provider.

c.     Billing Disputes

Billing concerns must be reported in writing within 30 days of the charge date. If not reported within that timeframe, the charge will be considered accepted.

VI. LEGAL TERMS AND LIABILITY

a.     Disputes

If a dispute arises, you agree to first contact us at fourbmanagement@gmail.com to attempt informal resolution. If informal resolution fails, disputes will be handled under the governing law section below and applicable dispute procedures permitted by law.

b.    Limitation of Liability

To the fullest extent permitted by law, My Trash Panda is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or similar losses. This includes (without limitation) missed service due to lack of access, municipal pickup issues, holiday schedule changes, weather, or third-party actions. If My Trash Panda is found liable for any claim, our total liability will not exceed the amount you paid for the service giving rise to the claim.

c.     Disclaimer

My Trash Panda is not responsible for damage to containers or property caused by acts of nature, vandalism, municipal equipment, third parties, misuse, or unsafe conditions created by the Customer.

d.    Authorized Agents

If you register service for a property, you do not own, you represent that you are authorized to do so and that you have authority to accept these Terms on behalf of the property owner.

e.     Non-Solicitation

During the term of this Agreement and for a period of two (2) years following its termination, you agree not to directly or indirectly solicit, recruit, or attempt to solicit or recruit any customers, service providers, contractors, or personnel associated with My Trash Panda for the purpose of diverting their business or employment relationship away from My Trash Panda.

This includes, but is not limited to:

                       i.         Contacting or attempting to contact My Trash Panda customers or service providers to encourage them to reduce, alter, or terminate their relationship with My Trash Panda.

                       ii.         Contacting or attempting to contact My Trash Panda service providers or contractors to encourage them to provide similar services outside of the My Trash Panda arrangement.

A violation of this section constitutes a material breach of this Agreement and may result in legal action, including injunctive relief and claims for damages, to the extent permitted by law.

f.      Sever-ability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in effect.

 

 

VII. ACCEPTABLE USE AND PROHIBITIONS

a.     Acceptable Use

Services must be used only for their intended purpose.

b.    Prohibited Use

You agree not to:

                        i.         Interfere with service performance

                       ii.         Provide false access instructions

                      iii.         Harass or threaten Service Providers

                      iv.         Attempt to gain unauthorized access to any scheduling or payment systems

                      v.         Use our services to support unlawful activity

We may suspend or terminate service for violations.

VIII. ADMINISTRATIVE AND MISCELLANEOUS

a.     Changes to Terms

We may update these Terms by posting revisions on our Website. Continued use after posting constitutes acceptance.

b.    Electronic Communications

You agree that communications provided electronically (email, website notices, or SMS if you opt in) satisfy any legal requirement that such communications be in writing.

IX. MESSAGING TERMS (If you opt in)

a.     General

If you opt in to receive messages, you agree that we may send service-related updates (such as schedule reminders, access issues, or changes to service timing) by SMS or email.

b.    Message Frequency and Rates

Message frequency varies based on your service schedule and interaction. Message and data rates may apply depending on your carrier.

c.     Opting Out

You may opt out of SMS messages at any time by following the instructions provided in the message, or by emailing fourbmanagement@gmail.com.

d.    No Requirement to Buy

Consent to receive messages is not a condition of purchase.
